DEFINITIONS:

Customer – the term “customer” applies to an individual or legal entity that uses the service provided by “Everyday Krakow” company (hereinafter called “Agent”), and therefore agrees to the terms and conditions displayed here.
Agent – Everyday Krakow is a company set up on the basis of a civil partnership. It is based in Poland at Dzielskiego 8/27, 31-465 Kraków. Everyday Krakow (hereinafter called the “Agent”) performs a service as an online hotel reservations agency.

AGREEMENT TO THE TERMS AND CONDITIONS:

1. Confirmation of a reservation by the Customer (via the website www.everydaykrakow.com, email, fax or phone conversation) is deemed as full agreement with the terms and conditions presented herein.
2. The customer agrees to the terms and conditions also on behalf of all individuals for whom the service is purchased.

RESERVATION AND CONFIRMATION PROCCESS
1. Reservations are made through the system www.everydaykrakow.com only when the Customer has filled the application form correctly, providing all the requested data and securing the reservation with credit card details (in exceptional cases of individual reservation and in group reservations prepayment is needed to secure the reservation).
2. The Customer is legally bound to provide accurate information to the Agent.
3. Reservations are made ON REQUEST basis, that means that they are confirmed only after checking the availability in the chosen Hotel by the Agent.
4. After making each reservation on behalf of the Customer, the Agent issues a confirmation letter which is then sent to the email address specified in the application form.
5. If the confirmation letter is not received by the Customer, he is obliged to notify the Agent about this fact.

PRICES
1. Prices offered on the website www.everydaykrakow.com are per room and per night including VAT (value-added tax) and breakfast. If the Hotel does not provide breakfast within the price, this fact is stated in the description of a given hotel and in the confirmation letter sent to the Customer.
2. All additional services must be paid by the Customer at the hotel.
3. The Agent guarantees that the prices offered via www.everydaykrakow.com system are free of booking fees.
4. The price quoted at the time the Customer secures the reservation, and stated in the confirmation letter, is the price that the Customer agrees to pay for the booking.

PAYMENT METHODS
1. The reservation price made via the system www.everydaykrakow.com, after previously providing the credit card details, is paid directly at the hotel with credit card or cash.
2. If a prepayment is made before the customer arrives at the hotel, the customer is obliged to pay the remainder of the cost of the reservation directly at the hotel.
3. All hotel bookings should be paid in Polish Zloty (PLN). If the hotel agrees, the Customer may pay in foreign currency. In this case the price is converted from Polish Zloty (PLN) according to the exchange rate used in the hotel where the customer is staying.

GUARANTEES AND PREPAYMENTS
1. The basic guarantee of an individual reservation is providing the credit card details of the Customer. In exceptional cases of individual reservations and in all group reservations it is the prepayment that secures the booking.
2. The prepayment is the cost of the first night's stay - unless, in case of group reservation, different conditions were agreed when confirming the reservation.
3. The credit card, that secures the reservation for the Customer, must be valid until the service is terminated (the date of leaving the hotel).
4. The credit card is not charged in advance. The hotel, however, has the right to carry out pre-authorisation of a sum equivalent to the first night’s stay to ensure that the card is valid and that adequate funds are available to cover a cancellation fee.
5. If pre-authorisation (via credit card) is not possible, the Agent will inform the Customer about this fact. If a new guarantee is not provided by the Customer within 24h of the information about the failure of the pre-authorisation, the reservation is cancelled.

CHANGES IN RESERVATION
1. Any changes to a reservation – except for the last minute ones made on arrival day – must be made in written form. The Customer is obliged, when making the changes, to provide the reference number of the reservation and all the details needed to enable  the changes by the Agent.
2. The Agent does not guarantee to make any changes to a given reservation – it is dependant on the availability in the hotel. The Agent will inform the Customer if a requested change cannot be made.
3. In a case where changes made to a prepaid reservation result in an overpayment, the Agent will refund the amount of the overpayment. However, the Customer will pay any bank charges or transfer costs incurred.
4. If a change involves cancellation of some of the rooms, changing a hotel or date of arrival or decreases the cost of a reservation, such changes are free of charge only within the period stated in the cancellation terms that are displayed in a profile of a given hotel. In case of group reservation, free of charge cancellation period is set up individually when confirming the reservation.

CANCELLATION POLICY
1. Individual and group reservations may be cancelled free of charge only within the cancellation period. In case of individual reservation the free of charge cancellation terms are displayed in a hotel profile. Cancellation period for group reservations is set up individually when confirming the reservation.
2. If a reservation was guaranteed with a previous prepayment (and its cancellation is done within the period stated in reservation policy of a given hotel) the amount is refunded in total. It is the Customer, however, who covers the bank transfer costs.
3. In case of cancellation made in a shorter period than the policy states, or in case the guests do not show up in the hotel without prior cancellation, there is a cancellation fee.
4. For individual reservations the cancellation fee is equivalent to the first night’s stay (and is charged from the credit card provided by the Customer or deducted from a prepayment). In the case of group reservations the cancellation fee is the cost of the first night's stay - unless other conditions, when confirming the reservation, were agreed in writing.

HOTEL INFORMATION
1. The Agent will make all possible effort to ensure that the Hotel information displayed in the system is correct and up to date. The Agent, however, is not liable for any omissions and errors in the descriptions.
2. The Hotel information is provided by the Hoteliers and Everyday Krakow does its best to ensure correct information before publishing it. However, whilst endeavouring to be accurate hotels reserve the right to amend their details and descriptions without notifying the Agent (Everyday Krakow).
3. The star rating of the displayed hotels is a subjective indication of the accommodation standard. The Agent takes into account the official Polish hotel categorisation system. In case the Hotel is not officially categorised, a subjective rating of 1-5 stars is used.

LIABILITIES
1. The Agent bears responsibility for inconveniences caused by mistakes of its employees. The liability, however, will not exceed the cost of the service purchased by the Customer from the Agent.
2. The Agent is not accountable for any inconvenience that occurs due to a mistake or omission by the Hotel (for example if the Hotel oversold its accommodation or if the damage results from a disconnection of some services in the Hotel) or due to unforeseeable circumstances that are not dependent on any actions taken by the Agent.
3. The Agent is not liable for the standard of the service in any of the Hotels described on the website and does not bear any responsibility for the losses caused by the Hotel employees.
4. In a rare situation where the Hotel refuses to accommodate a Customer with a prior reservation, it is the Hotel that bears responsibility for offering accommodation of the same standard and the same (or lower) price. In case of a higher price for the alternative hotel, the difference in price will be covered by the Hotel originally booked.
5. The Customer has the right to refuse the alternative hotel. In a case where a  prepayment was made – it will be refunded in full to the Customer.
6. An accepted refund of the prepayment to the Customer, or a refusal of the alternative accommodation by the Customer at the same or lower cost, exhausts all the claims of compensation that the Customer may have towards the Agent.
7. The refund of the prepayment will be sent to the bank account details from which it was received.
8. Only the Customer (and the individuals on behalf of whom the service was purchased) are responsible for any damage caused in the place of accommodation.

SECURITY OF PERSONAL DATA
1. The Agent guarantees the security of personal data and credit card details of the Customer.
2. The data provided by the Customer is shared only with the requested Hotel, in order to complete a service that the Customer wishes to purchase.
3. Credit Card details are not stored in the Agent’s system to decrease the chances of its loss.
4. Information concerning personal data and credit card details of the Customer are sent to the Agent by certified Secure Socket Layer (SSL), which provides authentication and communication privacy.

ADDITIONAL ARTICLES
1. The Agent has the right to make changes concerning the terms and conditions.
2. These conditions are public and the Customer is obliged to get acquainted with them.
